“How long will my case take?” is one of the most common questions we hear. The honest answer: it depends. Some Georgia personal injury claims settle in a few months; others, especially serious-injury cases or those that go to litigation, can take a year or more. Here’s what the timeline usually looks like and what affects it.

The typical stages of a personal injury case

  1. Medical treatment. We usually wait until you reach “maximum medical improvement” so we know the full extent of your injuries before valuing the claim.
  2. Investigation & demand. We gather records and evidence and send the insurer a demand for compensation.
  3. Negotiation. Most cases settle here, after back-and-forth with the adjuster.
  4. Litigation (if needed). If the insurer won’t offer fair value, we file suit – which adds time but often increases the recovery.

What affects how long it takes

The biggest factors are the severity of your injuries (more serious injuries take longer to fully assess), whether liability is disputed, how cooperative the insurer is, and whether the case settles or goes to court. Rushing to settle before you’ve finished treatment is one of the most common and costly mistakes – you can’t reopen a claim later if your injuries turn out to be worse than expected.

Should you settle quickly or wait?

Faster isn’t always better. A quick settlement often means leaving money on the table. The goal is the right outcome, not just a fast one. A good lawyer balances getting you paid promptly with making sure the settlement actually covers your full losses. Learn more on our personal injury page.

Frequently asked questions

Why do some cases take longer than others?

Mainly the severity of injuries, whether fault is disputed, how the insurer behaves, and whether the case settles or goes to litigation. Serious cases take longer because we must fully understand your future medical needs first.

Is it bad if my case goes to litigation?

Not at all. Filing suit signals you’re serious and often leads to a better offer. Many cases still settle after a lawsuit is filed, before trial.

Will I get money faster if I settle right away?

Possibly, but early offers are usually far below full value, and you can’t reopen the claim if your injuries worsen. It’s usually worth waiting for a fair, complete settlement.
